Terms of Service
Please read these terms carefully before using WimChat. By creating an account you agree to these terms.
1. Acceptance of Terms
By accessing or using WimChat you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use WimChat.
2. Description of Service
WimChat is a multi-tenant SaaS platform that enables businesses to manage customer communications across WhatsApp, Facebook Messenger, and Instagram through a unified team inbox.
3. Account Registration
- 3.1 You must provide accurate and complete information when creating an account.
- 3.2 You are responsible for maintaining the security of your account credentials.
- 3.3 You must be at least 18 years old to create an account.
- 3.4 One free trial per person, business, phone number, and payment method. Attempting to circumvent this by creating multiple accounts is strictly prohibited and will result in permanent ban.
- 3.5 You must verify your email address and phone number to activate your account.
4. Free Trial
- 4.1 New accounts receive a 7-day free trial on the selected plan.
- 4.2 A valid payment method is required to start a trial.
- 4.3 You will not be charged during the trial period.
- 4.4 After 7 days your payment method will be automatically charged for the selected plan unless you cancel before the trial ends.
- 4.5 Trial abuse — including but not limited to creating multiple accounts to obtain multiple trials — will result in immediate termination of all accounts and permanent ban from the platform.
5. Subscriptions & Billing
- 5.1 Subscriptions are billed monthly in advance.
- 5.2 Prices are in USD and exclude applicable taxes.
- 5.3 Failed payments will trigger a grace period of 24 hours before account suspension.
- 5.4 You can cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds for partial months.
- 5.5 We reserve the right to change pricing with 30 days notice. Existing subscribers will be notified by email.
6. Acceptable Use
You agree NOT to use WimChat to:
- Send spam or unsolicited messages
- Violate WhatsApp, Meta, or Instagram policies
- Harass, abuse, or harm any person
- Distribute malware or malicious content
- Impersonate any person or organization
- Violate any applicable laws or regulations
- Attempt to gain unauthorized access to our systems
- Reverse engineer or copy our software
- Resell or sublicense WimChat without permission
7. Platform Integrations
- 7.1 WhatsApp integration requires a valid WhatsApp Business API account. You are responsible for compliance with WhatsApp Business Policy.
- 7.2 Messenger and Instagram integration requires valid Facebook/Meta business accounts. You are responsible for compliance with Meta's policies.
- 7.3 We are not responsible for changes made by WhatsApp, Meta, or Instagram to their APIs or policies that affect our service.
8. Data & Privacy
- 8.1 You own your data. We do not claim ownership of your business data or customer conversations.
- 8.2 You grant us a limited license to process your data solely to provide the WimChat service.
- 8.3 You are responsible for obtaining proper consent from your customers to use their data through WimChat in accordance with applicable laws (GDPR, CCPA, etc.).
- 8.4 We will maintain appropriate security measures as described in our Privacy Policy.
9. Service Availability
- 9.1 We aim for 99.9% uptime but do not guarantee uninterrupted service.
- 9.2 Scheduled maintenance will be announced in advance.
- 9.3 We are not liable for downtime caused by third-party platforms (WhatsApp, Meta, etc.).
10. Limitation of Liability
To the maximum extent permitted by law, WimChat shall not be liable for:
- Lost profits or revenue
- Lost customers or business opportunities
- Indirect or consequential damages
- Damages exceeding the amount paid in the last 3 months of subscription
11. Termination
- 11.1 You may cancel your account at any time from billing settings.
- 11.2 We may suspend or terminate accounts that: violate these terms, have failed payments, are involved in fraud or abuse, or have been inactive for 12+ months (with notice).
- 11.3 Upon termination your data will be retained for 30 days then permanently deleted.
12. Changes to Terms
We will notify you of material changes by email and in-app notification at least 14 days before they take effect. Continued use after changes constitutes acceptance of new terms.
13. Governing Law
These terms are governed by applicable law. Disputes will be resolved through binding arbitration before resorting to litigation.
